[Chile] has been under a state of siege for reasons of internal defence since 11 March 1976; the state of siege was legally proclaimed by Legislative Decree No. 1.369.
The proclamation was made in accordance with the constitutional provisions concerning state of siege, which have been in force since 1925, in view of the inescapable duty of the government authorities to preserve public order and the fact that there continue to exist in Chile extremist seditious groups whose aim is to overthrow the established Government.
As a consequence of the proclamation of the state of siege, the rights referred to in articles 9, 12, 13, 19 and 25 (b) of the Covenant on Civil and Political Rights have been restricted in Chile.

By Decree No. 1.037, the Government of Chile declared a state of siege throughout the national territory from 8 September to 6 December 1986, for as long as circumstances warrant. The notification specifies that Chile has been subjected to a wave of terrorist aggression of alarming proportions, that an alarming number of attacks have taken the lives of a significant number of citizens and armed forces personnel, massive stockpiles of weapons were discovered in terrorists hands, and that for the first time in the history of the Republic, a terrorist attack was launched on H.E. the President of the Republic.
The notification specifies that the rights set forth in articles 9, 12, 13 and 19 of the Covenant would be derogated from.

Termination of the state of emergency and of the state of danger of disturbance of the domestic peace in Chile as from 27 August 1988, [...] thereby bringing to an end all states of ex ception in the country, which is now in a situation of full legal normality.
23 March 2010
Owing to the earthquake that took place in Chile on 27 February 2010, the Government of Chile decreed a 30-day constitutional state of disaster emergency in the regions of Maule and Bío Bío, by Supreme Decrees Nos. 152 and 153 of 28 February 2010, respectively. In addition, by Supreme Decree No. 173, a constitutional state of disaster emergency was declared by the Government of Chile in the Libertador Bernardo O'Higgins region. Under these measures, the President of the Republic may restrict fundamental freedoms. The freedoms that may be restricted are freedom and movement and of assembly. Goods may be requisitioned and property rights limited in accordance with article 43 of the Constitution.

The Secretary-General received from the Government of Chile a notification dated 25 March 2020, made under article 4 (3) of the above Covenant, regarding the declaration of a state of emergency in the entire territory of Chile for a period of 90 days starting on 19 March 2020, by Decree No. 104 dated 18 March 2020.

The Secretary-General received from the Government of Chile a notification dated 14 August 2023, made under article 4 (3) of the above Covenant, regarding the declaration of the state of emergency in the Chilean territory since 17 May 2022, pursuant to Supreme Decree No. 189 of 2022, and its extensions. The extensions have been ordered for consecutive periods of 15 days, by Supreme Decrees Nos. 199, 214, 219, 223, 231, 242, 245, 270, 285, 296, 307, 320, 335, 356 and 365 of 2022, and Nos. 12, 40, 47, 81, 93, 100, 112, 122, 134, 143, 158, 166, 182, 192 and 203 of 2023, all issued by the Ministry of the Interior and Public Security. In addition, the aforementioned Supreme Decree No. 189 was amended by Supreme Decrees Nos. 262 of 2022 and 156 of 2023.
The latest extension, declared by Supreme Decree No. 203 of 9 August 2023 for an additional period of 15 days from the end of the period established by the previous extension, is in force up to 24 August 2023.

The Secretary-General received from the Government of Chile a notification dated 13 October 2023, made under article 4 (3) of the above Covenant, regarding the extension of the state of emergency in the Chilean territory declared on 17 May 2022 pursuant to Supreme Decree No. 189 of 2022.
The aforementioned state of emergency was extended, with the agreement of the National Congress, for periods of 15 days, through Supreme Decrees Nos. 221, 229, 239 and 256 of 2023, all issued by the Ministry of the Interior and Public Security. The latest extension, ordered by Supreme Decree No. 256 of 6 October 2023, issued by the Ministry of the Interior and Public Security, is for an additional period of 15 days from the end of the period established by the previous extension, that is, up to 23 October 2023.
On 8 November 2023, the Permanent Mission of provided the following additional information:
- Supreme Decree No. 221 extended the state of emergency from 25 August to 8 September 2023;
- Supreme Decree No. 229 extended the state of emergency from 9 to 23 September 2023;
- Supreme Decree No. 239 extended the state of emergency from 24 September to 8 October 2023; and
- Supreme Decree No. 256 extended the state of emergency from 9 to 23 October 2023.

The Secretary-General received from the Government of Chile a notification dated 28 December 2023, made under article 4 (3) of the above Covenant, regarding the extension of the state of emergency in the Araucanía Region and in the Arauco and Biobío Provinces of the Biobío Region declared on 17 May 2022 pursuant to Supreme Decree No. 189 of 2022.
The aforementioned state of emergency was extended, with the agreement of the National Congress, for consecutive periods of 15 days, through Supreme Decrees Nos. 265, 293, 339, 354 and 379 of 2023, all issued by the Ministry of the Interior and Public Security. The latest extension was declared by Supreme Decree No. 379 of 22 December 2023, issued by the Ministry of the Interior and Public Security, and is for an additional period of 15 days from the end of the period established by the previous extension, that is, up to 7 January 2024.

The Secretary-General received from the Government of Chile a notification dated 6 February 2024, made under article 4 (3) of the above Covenant, regarding the declaration of a state of emergency in the provinces of Marga Marga and Valparaíso of the Valparaíso Region, by supreme decree No. 83 of the Ministry of the Interior and Public Security published on 3 February 2024, for a period of 30 days ending on 4 March 2024 in response to the forest fires in the area.

The Secretary-General received from the Government of Chile a notification dated 1 March 2024, made under article 4 (3) of the above Covenant, regarding the further extension of the state of emergency in the Araucanía Region and in the Arauco and Biobío Provinces of the Biobío Region for two consecutive periods of 30 days from the expiration of the period provided for in the previous extensions, i.e., until 7 March 2024, through Supreme Decrees Nos. 29 and 81 issued by the Ministry of the Interior and Public Security.
