Burkina Faso

       By a notification dated 6 March 2025, the Government of Burkina Faso informed the depositary that by Decree No. 2023-0444/PRES-TRANS/PM/MDAC/MATDS/MJDHRI of 14 April 20231, declared a state of emergency in 22 of the country’s 45 provinces from 30 March to 29 April 2023, pursuant to Act No. 023-2019/AN of 14 May 2019 on states of siege and states of emergency in Burkina Faso. The declaration of a state of emergency is aimed at combating terrorism swiftly and effectively and restoring calm among the population. The extension of the state of emergency for a period of six months, from 29 April to 29 October 2023, was authorized by Act No. 007-2023/AN of 12 May 2023 extending the state of emergency declared by Decree No. 2023-0444. It is aimed at allowing local authorities to create the conditions for better promotion and protection of the human rights of people unjustly affected by violence and the cruelty of terrorist attacks.

       The Government of Burkina Faso further notified that in accordance with article 5 of Decree No. 2023-0444, the measures provided for in the context of the state of emergency may involve a derogation from the obligations under the International Covenant on Civil and Political Rights, in particular articles 9, 12, 17, 19 and 21. However, the measures do not authorize any derogation from the provisions of articles 6, 7, 8 (paragraphs 1 and 2), 11, 15, 16 or 18 of the Covenant.

       The Secretary-General received from the Government of Burkina Faso a notification dated 17 April 2019, made under article 4 (3) of the above Covenant, regarding the declaration, by Decree No. 2018-1200/PRES of 31 December 2018, of a state of emergency in 14 provinces in the country, with effect from 1 January 2019, and its extension for a period of six months, from 13 January to 12 July 2019, pursuant to Act No. 001-2019/AN of 11 January 2019.
